Abstract:
This article examines the role of foreign judges serving on the courts of two common law jurisdictions: Non-Permanent Judges on the Hong Kong Court of Final Appeal and the recently created Singapore International Commercial Court. Such judges have an influence on the development of the domestic jurisprudence for each jurisdiction, but the study also demonstrates that the judges have a disproportionate influence in terms of citations in their home jurisdiction. The article problematises the issues and considers what lessons can be learned for the development of the Singaporean court from the Hong Kong experience. In contrast to other studies of the practice of international judges, we examine the influence of such judges specifically in the field of private law.


About the Speaker:
James Lee is Reader in English Law and PC Woo Research Fellow, The Dickson Poon School of Law, King’s College London; Visiting Professor, Hong Kong University; Senior Visiting Fellow, Gilbert + Tobin Centre of Public Law, Faculty of Law, University of New South Wales; and Associate Academic Fellow of the Honourable Society of the Inner Temple. With Jamie Glister, he is Co-Editor of Hanbury & Martin: Modern Equity, the 21st edition of which will be published later this year.
