Abstract:
The People’s Republic of China took thirteen long years of debates, deliberations, preparations and a painstaking drafting process to finally adopt its first Anti-Monopoly Law (AML). China’s AML was passed on 31st of August, 2007 and it came into effect on 1 August 2008. There are a total of 57 articles in the AML. While Article 55 of the AML is pertinent to the abuse of intellectual property rights (IPRs), its implementation was only initiated in the year 2014 and onwards. On 23 March 2017, the Antimonopoly Commission of China’s State Council published the long-expected draft Guidelines on Prohibition of Abuses of Intellectual Property Rights for public comments. The consultation period ended 21 April 2017, and it is expected that the final version will be adopted by the end of 2017. This talk discusses the overview of China’s AML, the historical aspects of IPRs in China and Article 55 of the AML, which regulates the abuse of IPRs. It also addresses the most updated guidelines pertinent to Article 55.

About the speaker:
Dr. Farrukh Nawaz Kayani, just completed his Second Post-Doctorate in Economic Law from the prestigious KoGuan Law School of Shanghai Jiao Tong University. He got his first Post-Doctorate from Istanbul University, Turkey and his PhD degree from University of International Business and Economics Beijing, China. In summer 2009, he also worked upon a project at Quality Assurance Division of International Atomic Energy Agency, Vienna, Austria.
