In Ireland, Competition Law has been enforced since 1996 as part of the Criminal Law regime. As such, it radically diverges from the EU model of civil/administrative enforcement. Recently, Hong Kong enacted a Competition Law which adopted the Criminal Law model of enforcement. My research examines the unexplored topic of whether the overtly similar Competition Law models in Hong Kong and Ireland truly share a common rootstock or whether there are significant differences? Answering this question entails researching from an external vantage point on why the Hong Kong legislature chose the atypical criminal model. Furthermore, it prompts analysis of the significance of the divergence from the global trend towards civil/administrative enforcement models. My research aims to challenge the prevailing orthodoxy in the EU that civil/administrative models are better than criminal models. This research project is funded by a competitively awarded grant from the Irish Research Council.

Dr. Mary Catherine Lucey BCL, LLM, BL is Assistant Professor and Head of Global Engagement in the UCD Sutherland School of Law where she teaches EU Competition Law. She was a Visiting Professor at Fordham University, New York. Currently, she is a Non-Governmental Advisor to the Irish Competition and Consumer Protection Commission. Her PhD thesis, awarded by the London School of Economics and Political Science, examined the interface between EU Competition Law and the Common Law Restraint of Trade Doctrine. Her research has been published in journals including Legal Studies, and Journal of Antitrust Enforcement.
